Our Terms and Condition

General Terms and Conditions Online language course
(Version 1 / Status: 16 January 2019)

The following general terms and conditions of contract (hereinafter referred to as “GTC”) form an integral part of the present contractual relationship between the customer and Inforce Group AG, Stettbachstrasse 6, 8600 Dübendorf [company identification: CHE-142.319.583], which in this case occurs under its trademark “Mandalingua” and is abbreviated to “ML” in the following conditions. The terms and conditions are available on the website: mandalingua.inforcegroup.cyon.site at any time and are enclosed with the written confirmation.

1. Registration and conclusion of contract

The registration can be made either verbally (by phone / in person) or in writing (via e-mail or post). A contractual relationship is established with the dispatch of the written course confirmation. The conclusion of the contract is personal and can only be transferred to a third person with the consent of ML.

2. Course fee

The course fees are shown on the website and will be confirmed in the written course confirmation. Increased customer requirements for the training content of Sprachkureses may result in higher course fees than are published on the website.

Volume discounts are granted from 150 private lessons or when booking more than 15 weeks of group lessons per year. These individual conditions are to be agreed with ML upon registration and will be confirmed in writing by ML.

3. Payment terms

The payment of the course fee has to be made within 10 days after invoicing. The date of receipt of payment is noted on the invoice.

The course fee is to be paid in Swiss Francs or Euros via bank or postal transfer. Payments by credit and debit cards are not possible. Any bank and postal charges are charged to the customer.

Should the course fee not be received in due time despite a reminder and the setting of a grace period, ML is entitled without further correspondence to withdraw from the contract and to demand cancellation costs of CHF 60.00 / EUR 55.00. The assertion of damages in accordance with the rules of the Swiss Code of Obligations remains reserved.

4. Duration of the lesson

One lesson lasts 45 minutes.

5. Period of validity of the courses / lessons

Unless otherwise agreed, group courses during the planned duration of the course and private courses are to be completed 6 months after the conclusion of the contract. Unused services will be forfeited without compensation after this period and there will be no claim to the recovery of missed or unused lessons. In consultation with ML, extension packages can be purchased for courses/lessons that have expired.

6. Private Lesson

A qualified teacher, who selects and instructs ML, teaches a customer via Skype. The teacher determines the time of teaching and the duration with the best possible consideration of the customer’s wishes and the learning success. If, for whatever reason, a customer does not apologize for an agreed lesson, that lesson will be deemed to have been performed. In the event of a disability, this must be reported to the teacher at least 24 hours in advance by telephone or e-mail, otherwise, the lesson is considered completed.

If private courses are to take place during the public holidays, such as Chinese New Year or National Holiday, a surcharge is payable under Chinese labor law. The amount of the surcharge will be communicated to the customer prior to the lesson.

If ML is involved in the reorganization of lessons, a fee of CHF 30.00 / EUR 25.00 per reorganization is due.

7. refund policies

Should a customer be unable or unwilling to start the agreed service for any reason, he / she can notify the ML in writing before the start of the course (in detail at ML). An annulation fee of CHF 100.00 / EUR 90.00 will be charged and the following reimbursements of the course fee will be made within 10 days, depending on the time of notification:

– More than 30 days before the course starts: 100% refund

– 29 days to 20 days before the course starts: 75% refund

– 19 days to 10 days before the course starts: 50% refund

Less than 10 days before the course starts: 25% refund

If the course has started, there will be no reimbursement and the course fee will be forfeited to ML.

Alternatively to a refund, the customer may choose to be credited with the appropriate refund amount, which he can then use for ML services within 24 months. In this case, the cancellation fee is waived. If the credit note is not used within 24 months, it will be forfeited to ML.

8. Liability

ML is responsible for the careful selection and instruction of the teacher. Further liability is excluded. In particular, ML accepts no liability for any defective connection quality.

9. Applicable law and jurisdiction

Only Swiss law is applicable. Jurisdiction is CH-8600 Dübendorf (registered office of the company).

For the sake of readability, the simultaneous use of male and female forms is dispensed with. All persons and function names are valid regardless of the female or male language form for both sexes
